Preliminary building application
Service description
Before submitting a building application, a so-called preliminary decision can be applied for on individual issues of the building project.
An application for a preliminary decision can be used to obtain legally binding information on whether a plot of land can be built on (even before the intended purchase of such a plot). A positive preliminary decision binds the building supervisory authority for the duration of its validity (currently 3 years), i.e. it can then no longer reject a building project for reasons that were already to be examined in the preliminary decision procedure. A positive preliminary decision therefore provides legal certainty for the concrete planning of a building project.
A preliminary building application is always recommended if the building project differs greatly from the surrounding development or if binding information is only to be obtained on individual problematic points of a building project. The three-year period of validity of the preliminary building permit can be extended by up to one year under certain conditions upon application in text form.
Required documents
The building documents belonging to the preliminary building application are described in the NRW Building Inspection Ordinance. These include
- Form "Application for preliminary decision",
- the site plan on a scale no smaller than 1:500,
- the extracts from the cadastral map series (extract from the real estate map),
- If applicable, building design sketch (floor plans, views, sections)
