Who has to prove that the property is free of explosive ordnance?
In accordance with Section 16 (1) sentence 2 of the Building Regulations for the State of North Rhine-Westphalia (BauO NRW), a building plot must be suitable for building structures. This also includes the absence of explosive ordnance on the site. Of course, the absence of explosive ordnance is only relevant if work is to be carried out in the ground. The obligation under building law to clarify whether explosive ordnance is specifically suspected on a property to be built on and, if necessary, to initiate measures to dispel this suspicion, is the sole responsibility of the building owner.
Only in the building permit procedure for certain special buildings will you be expressly informed of the clarification of a possible suspicion of explosive ordnance in individual cases by the inclusion of a condition precedent regarding the entry into force of the building permit. In all other building permit procedures (simplified procedure and exemption procedure), you will not receive any information from the building inspectorate on this issue. You must then take up the issue of suspected explosive ordnance on your own initiative and clarify it yourself.
Also for reasons of liability and occupational safety, explosive ordnance contamination should always be checked for every construction project involving earthworks or forces acting on the ground.
