Service description
Public roads, paths and squares can also be used for purposes other than traffic (public use).
Uses that go beyond public use and impair or exclude it are, for example:
- Erection of scaffolding, containers, construction cranes, construction fences, etc. or the storage of building materials
- economic or commercial activities (e.g. the sale of goods of all kinds on a pedestrian path)
- Use of the airspace above the street (e.g. by advertising structures)
- Installation of tables and chairs, outdoor catering
- Advertising boards and merchandise stands in public traffic areas
- Setting up merchandise and information stands
- the practice of street art
- Distribution of flyers
- Promotional campaigns
These special uses are subject to approval
They require permission from the pilgrimage town of Kevelaer.
Note:
Special use may only commence once permission has been granted by the competent authority.
Any use of the public traffic area in excess of the permission granted constitutes an administrative offense pursuant to Section 59 of the NRW Road and Paths Act, which can be punished with a fine.
If you wish to share the use of the roads without affecting public use, e.g. if you wish to use only the grass verge or lay cables in the embankment area, this is considered other use of the road. In this case, contractual regulations must be concluded in accordance with civil law and must therefore be applied for separately.

Depending on the type of special use, the competent authority may require documents and evidence, e.g.

- Vehicle registration document for sale from a vehicle
- Restaurant permit for outdoor catering
Costs
A fee is generally charged for the granting of a special use permit. The amount of the fee depends, among other things, on the area used, the time period and the location (Zone 1 or Zone 2). The basis of assessment here is the fee tariff according to the statutes on permits and fees for special use of public roads in the pilgrimage town of Kevelaer (special use statutes).
Additional fees may be charged for ordering traffic control measures.

Procedure
You must apply for a special use permit from the responsible authority.
Permission is granted at the discretion of the authorities.
Above all, it examines what effects a permit would have on the use of the road.
In doing so, it must weigh up the public interest in the safe use of the road (public use) against the private interest in applying for special use.
The intended special use may not:
- interfere too much with the public use of others,
- endanger escape routes,
- cause a nuisance to pedestrians or local residents,
- pollute the road excessively or
- impair the cityscape
The competent authority shall limit the duration of the permit and grant it on a revocable basis. It may impose conditions and requirements.

Deadline
The application must be submitted in writing at least four weeks before the intended use of the special use.
